4. Consent and withdrawal

We obtain consent where required—clearly, freely and for specific purposes. You may withdraw consent at any time, subject to legal or contractual limits and reasonable notice, by contacting Elton at elton@paragym.com, by using unsubscribe links in emails, or via the cookie banner (“Manage Consent”).

Withdrawing consent may limit some services (for example, we cannot process a booking without the information needed to deliver it). Cookie consent for statistics and marketing is opt-in for Québec visitors (Complianz).

5. Cookies and similar technologies

We use necessary cookies for the site to work (including language and consent preferences). Statistics cookies (Google Analytics) and marketing/tracking technologies (Meta / Facebook Pixel) load only after you accept them in the Complianz consent banner.

Details, the list of cookies and how to change your choice are in our Cookie Policy:

6. Communication to third parties

We do not sell your personal information. We share it only with service providers that need it to help us operate, or when the law requires it:

  • Momence — online scheduling, bookings, memberships, webchat and related payments (personal information handled under Momence’s terms/privacy policy).
  • Healcode / Mindbody widgets — scheduling widgets still embedded on some pages; data entered there is processed by Mindbody.
  • Google Analytics (Google LLC, United States) — site usage statistics, only after consent.
  • Meta Platforms (Facebook Pixel, United States) — advertising measurement / remarketing, only after consent.
  • SendGrid and/or Amazon SES (United States) — sending transactional and (where consented) marketing email.
  • ChemiCloud — website hosting (Canada).
  • WordPress plugins that support the site (e.g. Complianz for consent, Polylang for language, WP Rocket for performance, Rank Math for SEO) — generally technical/functional data.
  • Professional advisors (accountant, lawyer, insurer) and authorities when required by law or to protect rights and safety.

These providers act as service providers / agents or, for some analytics/ads tools, as independent controllers for their own purposes. We ask them to use personal information only for the services they provide to us, except where they are independent controllers (read their privacy policies).

7. Transfers outside Québec

Some providers above are located in the United States or store data there (notably Google, Meta, Momence/Mindbody, SendGrid, Amazon SES). When personal information is communicated outside Québec, Law 25 requires us to assess privacy risks. We have considered the sensitivity of the information, the purposes, and the contractual and technical safeguards available, and we take reasonable measures to protect it. By using our services that rely on these tools (for example booking online), you acknowledge that such transfers may occur.

[ASSUMPTION — please confirm] A written privacy impact assessment (évaluation des facteurs relatifs à la vie privée) covering these US transfers has been completed or will be completed and kept on file by the person responsible for personal information.

8. Retention periods

We keep personal information only as long as needed for the purposes above, then securely destroy or anonymize it. Periods below are proposed / assumed where marked—please confirm before publishing:

  • General inquiries / emails with no account: up to 24 months after the last exchange. [ASSUMED]
  • Client, membership and booking records: for the relationship, then 3 years. [ASSUMED]
  • Invoices and accounting documents: 7 years (tax / bookkeeping). [ASSUMED — confirm with your accountant]
  • Waivers and liability-related records: 3 years after last participation (or longer if a claim is open). [ASSUMED]
  • Marketing lists: until you withdraw consent, then promptly deleted/suppressed. [ASSUMED]
  • Analytics identifiers / cookies: according to each cookie’s lifetime (see Cookie Policy); analytics reports typically up to 26 months. [ASSUMED]
  • Security / server logs: up to 12 months. [ASSUMED]
  • Records of confidentiality incidents: at least 5 years after the incident (Law 25). [ASSUMED legal minimum]

9. Your rights

Subject to the Act, you may request:

  • Access to your personal information
  • Rectification of inaccurate, incomplete or ambiguous information
  • Withdrawal of consent to optional processing (e.g. marketing, non-essential cookies)
  • De-indexation — that we stop disseminating information or de-index a hyperlink, in the cases provided by Law 25
  • Portability — to receive computerized personal information you provided, in a structured and commonly used technological format, when held in that form

To exercise these rights, email elton@paragym.com (or write to the address above). We will respond within the time limits set by law. We may ask for information to verify your identity.

10. Security measures

We use reasonable administrative, technical and physical safeguards appropriate to the sensitivity of the information, including access controls on systems and mailboxes, HTTPS on the website, host-level security with our Canadian host, and limiting staff access to what is needed for their role. No method of transmission or storage is perfectly secure; we work to reduce risk and to improve our practices over time.

11. Minors

We offer courses for children. For a person under 14, we collect and use personal information with the consent of the person having parental authority (or tutor), except where the law allows otherwise. Teenagers 14 and over may, in many cases, consent themselves; we still encourage parental involvement for bookings and payments.

12. Confidentiality incidents

If a confidentiality incident presents a risk of serious injury, we will notify the Commission d’accès à l’information du Québec and the affected persons as required by Law 25, and we will keep a register of incidents.

13. Complaints

  1. Contact first the person responsible: Elton, elton@paragym.com, Paragym Inc., 5465 rue de Bordeaux, Montréal (Québec) H2H 2P9.
  2. If you are not satisfied with our response, you may contact the Commission d’accès à l’information du Québec: cai.gouv.qc.ca.

For matters under federal PIPEDA that are not resolved with us, you may also contact the Office of the Privacy Commissioner of Canada.

14. Changes

We may update this policy. The date at the top will change. The current version is always published on this page once approved. Material changes may also be announced by email or notice at the gym when appropriate.
